Mattoo case: SC commutes Santosh Singh's death sentence to life

NEW DELHI: The Supreme Court on Wednesday upheld the conviction of Santosh Kumar Singh in the 14-year-old Priyadarshini Mattoo rape and murder case but reduced the death sentence to life imprisonment, saying certain things were in his favour.

"The conviction is maintained," a Bench comprising Justices H S Bedi and C K Prasad said.

However, the Bench said "To our mind, certain things are in favour of appellant (Singh). We are converting the punishment of death sentence into the life imprisonment."

Singh, son of former senior IPS officer, had challenged his conviction and death sentence awarded by the Delhi high court which had set aside his acquittal by the trial court in the case.

The apex court had on July 29 reserved its verdict on Singh's appeal.



Singh, a law student in the Delhi University, had raped and murdered Priyadarshini, a third-year law student, in January 1996.

Singh was acquitted by the trial court on December 3, 1999, but the Delhi high court had on October 27, 2006, reversed that decision by holding him guilty of rape and murder.

CBI has sought upholding of the death sentence saying the high court had correctly appreciated the evidence leading to his conviction.

I saw an article in TOI some time back that majority of the SC judges are corrupt. Santosh managed to get a life sentence and there would be loopholes for him to get out and commit similar crimes because he is the son of an IPS Officer. Despite the rapid strides India has made, 'whom you know' plays an important role in India life, which is very sad indeed. My sympathies to Priyadarshini's family.

Why should he be hanged afterall he killed only one.What about kasab and company who after killing hundreds are still sitting in jail and enjoying five star treatments...

hilarious.... he has killed only one hahaaha. how many u think he should kill before being eligible for death sentence.Yes this is mockery of system. e brutally raped and murdered an innocent girl and anything less then death is not acceptable ..

The supreme court seems to be having a soft corner for death sentenced convicts. I am sure that the Hight Court had gone into merits before pronouncing the verdict.

In this case the Supreme Court has failed to demonstrate that the justice is 'shown to have been done'. It brings doubt into people's minds about the Indian judiciary being above corruption.

It shows how much value, a woman's life has in India. This is how women have been ridiculed in the past and will continue to be so. It just doesn't matter if a woman is raped, killed, harrassed. The country is heading towards nowhere in its culture. There exists no civil behaviour in the society. Women have to constantly live a scary life until their death.

Does this mean that he will serve another 14 years behind the bars or will be out as the justice already dragged for 14 years. Usually the amount of time already spent in jail is reduced from the final sentence. Life imprisonment is usually for 14 years in India. Does this mean this aquital in disguise. Something is not right here.

Dont you know that one of the Past CJ of SC has said that he is sure of 8 CJ's who were corrupt out of the 17 that have been appointed. Who will judge the judges, there is no mechanism. Our country sucks believe there is no jurisprudence worth the paper.

The judgment of the Hon'ble Supreme court is totally unfortunate. This is a case where the culprit had committed a heinous crime with impunity taking advantage of his father's official position arrogating unto himself as the rule of law. It is precisely what element of evidence that deterred the learned judges from confirming the capital punishment and reducing it to life term.This fellow with his father's clout would be let off on some golden events like Mahathma Gandhi's birthday or Independence day or some other solemn event carefully chosen by his supporters, that has been serving as an escape route for proven criminals who may be later enrolled as an activist of some political party.. This will create a very bad precedent in the history of criminal trial.

I request to CJI to investigate the link between SC judges involved in this case and accused. There Bank account and properties must be filtered/tracked. Even their phone calls may help to unearth their connections.

Shame on our justice system! Reducing the punishment is like pardoning him. Indian public feels cheated by the decision. He will soon be out of jail first on parole and later on for good. Don't we need to have a fresh look at our old rotten justice system?

The evidence as suggested is only circumstantial. Thats what goes in the defendant's favour. The CBI has done a shoddy job to not get a clear proof. The behavior of the defendant was also taken into account. Even if its real life imprisonment and not just 14 years as the SC has pointed out, I would take the judgment.

I think SC judges has gone mad, if this one was not of rarest one then which one is the rarest case one shd also not give the Capital Punishment as it is also not the rarest case as terriosm is not the rare crime but now a days it has become common.

The crime rate in the cities can be brought down only by severe punishments. Death sentence is not enough. He should realize. I dont think life imprisionment will make him realize.
